HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18484 of 2016 ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed to declare the notice, dated 18.04.2016 issued by respondent No.2 directing the petitioners to vacate lands to an extent of Ac.0-10 1⁄2 cents and Ac.0-10 cents in Survey No.129 of Vadlapudi Village, Gajuwaka Mandal, Visakhapatnam District, as arbitrary and illegal and consequently direct respondent No.2 not to dispossess the petitioners from the aforesaid lands.
2. Heard both sides.
3. Petitioners have questioned the notice, dated 18.04.2016, issued under Section 7 of the Madras Act 1905. Normally this Court would not interfere with the show cause unless it is without jurisdiction. It is open to the petitioners to submit the explanation to the notice, dated 18.04.2016. Therefore, I do not see any merit in the writ petition.
4. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
