The present Writ Petition is filed seeking issuance of writ of mandamus declaring the action of respondents in not refunding of excess stamp duty of Rs.2,40,140/- paid by the petitioner in respect of General Power of Attorney deed bearing document No.1671, dated 11.05.2017, registered in the office of respondent No.4, as illegal, arbitrary and contrary to G.O.Ms.No.178, dated 05.08.2017 Revenue (Registrartion-1) Department. The grievance of the petitioner is that he made an application on 09.10.2017, for refund of excess stamp duty paid in terms of G.O.Ms.No.178, dated 05.08.2017, and the same is not disposed of. Aggrieved by the same, the present Writ Petition is filed.
Heard both sides.
In view of the above facts and circumstances, without expressing opinion on merits, the writ petition is disposed of directing the competent authority to consider the application dated 09.10.2017, and take action in accordance with law, within a period of two (02) months from the date of receipt of the order.
