HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.6456 of 2017 ORDER:

Heard both sides and perused the grounds of revision and the impugned order of the lower Court.

Undisputedly among Exs.P1 and P2 and Exs.R1 to R12, but for his contention is his wife is equally employee and earning and she is not entitled maintenance, he could not produce including of the specific fact of she was working in Cocoan Management Consultant, Hyderabad. If at all there is any proof if he can secure, it is left open to him to file an application before the learned Judge, Family Court, to modify the order passed in I.A.No.334 of 2016 by considering such means of the wife for any entitlement, if so to what amount to modify from that change of circumstances including as the contention of he was hospitalized having sustained fracture and thereby he could not even move out and in that period also he is not liable. For such remedies left open to approach the lower court, but for that there is nothing to interfere with the order of the lower Court.

Accordingly and in the result, the Civil Revision Petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
