Gadilli Ramulu v. The State Of A.P
THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.P.No.6047 of 2016
ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 to A7 seeking to quash the proceedings in C.C.No.887 of 2015 on the file of Additional Judicial Magistrate of First Class, Srikakulam, for the offence punishable under Section 498-A, against them.
2. It is alleged in the charge sheet that A1, at the instigation of A2 to A7, subjected his wife i.e., de facto complainant, to cruelty and harassed her mentally and physically by demanding additional dowry of Rs.25 lakhs from her parents and not providing food. They also forced her to give divorce to perform another marriage to A1. Based on the complaint, a case in Cr.No.115 of 2015 u/s. 498-A IPC was registered against A1 to A7.
3. Heard and perused the material on record.
4. In view of the serious allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. At this stage, learned counsel for the petitioners confined his argument to the extent that the presence of the petitioners before the trial Court may be dispensed with. In view of the same, the presence of petitioners/A2 to A7 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.
5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
