The case of the petitioner is that impugned order dated 23-10-2017 is passed threatening to blacklisting the petitioner-firm, if the impugned amount is not paid. Learned counsel for the petitioner-firm submits that without any prior notice, straightaway impugned order is passed.
On the other hand, Smt.A.Deepthi, learned Standing Counsel for the respondent produced written instructions and submits that the petitioner-firm was issued several notices for depositing the amount and the petitioner-firm submitted explanation and after considering the same only, the impugned order is passed.
It is to be seen that recovery of amounts is one thing and blacklisting of petitioner-firm is another thing. Order of blacklisting of petitioner-firm leads to civil consequences, for which the petitioner-firm has to put on notice. In view of the same, the petitioner-firm shall treat the impugned order as show-cause notice and it is open to the petitioner-firm to submit explanation to the same within a period of two weeks from today and on such submission, the respondent-authorities consider the same and pass orders thereon. Till then, no coercive steps shall be taken against the petitioner-firm for blacklisting it.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
