SMT JUSTICE T. RAJANI CRIMINAL PETITION No.12603 of 2018 ORDER:

This petition is filed, under Section 438 of the Criminal Procedure Code, seeking for grant of anticipatory bail to the petitioner, who is A1, in Cr.No.72 of 2018 of Srikalahasthi Rural Police Station, Chittoor District.

Heard learned counsel for the petitioner and learned Public Prosecutor for the State.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and therefore, anticipatory bail may be granted to the petitioner.

Learned Public Prosecutor submits that earlier the petitioner along with other accused filed Crl.P.No.9290 of 2018 and this Court while granting bail to other accused dismissed the bail application of petitioner.

As this Court already dismissed the bail application of petitioner on merits of the case, the petition cannot be entertained. 6.

However, considering the request of the petitioner, this Court finds that it would suffice to direct the police concerned to issue

Section 41-A Cr.P.C. notice before effecting arrest of the petitioner if they propose to arrest him.

With the above direction, the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
