The case of the petitioners is that they were issued Notice dated 25.07.2015 under Rule 3 of the Andhra Pradesh Assigned Land (Prohibition of Transfers) and Rules, 2007 for violating the provisions of Section 3(2) of Andhra Pradesh Assigned Lands (Prohibition of Transfer) Act, 1977 and directed them to submit explanation in respect of the same. In pursuance to the same, the petitioners submitted explanation on 29.08.2016. But the respondent authorities without passing orders on the notice are trying to evict the petitioners. Aggrieved by the same, the present writ petition is filed.

Heard both sides.

Having issued the notice, the 2nd respondent shall consider the explanation filed by the petitioners and pass final orders.

In view of the same, the 2nd respondent is directed to consider the explanation filed by the petitioners duly affording an opportunity of hearing to them before passing the final orders. Till then, status-quo obtaining as on today shall be maintained by both the parties.

With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 17-09-2016 dv
