HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.27264 of 2016 ORDER:

This writ petition is filed against the order dated 28-01-2016, wherein revision filed by the petitioner was dismissed holding that the petitioner has not availed the remedy under Section 5(5) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 before the Revenue Divisional Officer, Miryalaguda. Heard learned counsel for the petitioner, who submits that petitioner, infact, filed appeal on 13-02-2015 and the same was rejected on 08-10-2015. Against the same, revision is filed. Learned Assistant Government Pleader for Revenue submits that no appeal is filed except the representation. Representation filed by the petitioner, dated 13-02-2015, goes to show that it is only application for reconsideration for Form-6 application, dated 06-11-2014 under ROR Act and no appeal is filed. Even the Revenue Divisional Officer also stated that the petitioner has to approach the Civil Court.

In view of the same, I do not see any ground to entertain the writ petition under Article 226 of Constitution of India. Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
