This Civil Revision Petition is filed under Article 227 of the Constitution of India aggrieved by the order dated 13.09.2017 passed in I.A.No.682 of 2017 in O.S.No.851 of 2009 on the file of the Court of the Principal Junior Civil Judge, Kurnool.
Heard the learned counsel for both parties and perused the record.
At the time of arguments, both counsel submitted that the trial court may be directed to record evidence on both sides and decide all the issues simultaneously including the preliminary issue. A perusal of the record reveals that each issue framed in the suit is interrelated to each other.
In view of the submissions made by both counsel, this court is not inclined to go into the merits of the main case. Having regard to the facts and circumstances of the case, the trial court is hereby directed to dispose of O.S.No.851 of 2009 as expeditiously as possible, preferably, within a period of six months from today. The trial court is further directed to give a specific finding on all the issues.
Accordingly, this Civil Revision Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand dismissed. _________________________ T.SUNIL CHOWDARY, J Date: July 5, 2018 Kvsn
