This writ petition is filed to declare the action of respondents in not taking any action against respondents 5 to 8 who are constructing permanent houses unauthorizedly on the Tank Bed land of Illamnaidu Tank situated in Sy.No.167 of Tokalavalasa village, Regadiamadalavalasa Mandal, Srikakulam District as illegal and arbitrary. Learned Assistant Government Pleader for Revenue produced written instructions stating that in pursuance to the complaint made by the petitioners, notices were issued to the encroachers. Since they have not submitted any explanations, necessary action was proposed to remove the illegal constructions on 04-06-2018 and requested for police protection. But due to "Navanirmanadeeksha" programme, the same could not be done. It is stated that action will be taken to remove the illegal constructions in the Illamnaidu Tank situated in Tokalavalasa village, Regadiamadalavalasa Mandal, Srikakulam District as per Land Encroachment Act, 1905 and other government instructions on eviction of encroachment in Tank Beds.

In view of the same, the writ petition is disposed of directing the 4th respondent to take appropriate action against the illegal constructions in accordance with law. There shall

be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
