HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.1643 OF 2016 ORDER:

The present Civil Revision Petition is filed, under Article 227 of the Constitution of India, by the petitioners - defendants, challenging the order, dated 13.10.2015, passed in I.A. No.446 of 2015 in O.S. No.560 of 2009, by the XIII Additional Chief Judge (Fast Track Court), City Civil Court, Hyderabad, whereby the petition filed under Order XVIII, Rule 17 of the Code of Civil Procedure, 1908, seeking to reopen the evidence of plaintiffs and recall the witness to cross examine by the defendants, was dismissed.

2. As per the material placed before this Court, during pendency of the present revision, the original suit bearing No.560 of 2009, itself was dismissed by the trial Court on 24.04.2017 on contest. Therefore, nothing remains to be adjudicated by this Court.

3. Accordingly, the Civil Revision Petition is dismissed as infructuous. No order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the present revision, stand closed.
