THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.863 OF 2016 ORDER:

This Criminal Revision Case, under Sections 397 and 401 of Cr.P.C., is filed against the docket order, dated 03.03.2016, in Crl.P.M.P.No.Nil of 2016 in C.C.No.140 of 2014 passed by the XV Additional Chief Metropolitan Magistrate, Nampally.

2. Heard.

3. The petitioner herein filed Crl.P.M.P.No.Nil of 2016 in C.C.No.140 of 2014 for advancement of case from 01.04.2016 to an early date. The Court below returned the said application as 'there is no provision for advancement of hearing. Challenging the same, the present revision is filed.

4. It is to be noted that the question of advancement of case and hearing of the matter at length is the prerogative of the Court dealing with the case. Hence, it may not be proper for this Court to pass an order advancing the case, more so, when the Calendar Case is of the year 2014.

5. Hence the present Criminal Revision Case is disposed of leaving it open to the trial Court to fix the date for hearing of the matter. Miscellaneous petitions, if any, pending in this revision shall stand closed.
