HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 2 6 7 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Abdullapurmet Police Station, Rachakonda Commissionerate, dated 28.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The petitioner herein has approached the Commissioner of Police, Rachakonda Commissionerate, and submitted a petition, dated 20.10.2018, wherein it was stated that he is the absolute owner and possessor of plot No.9, admeasuring 424.4 Sq.Yds., in Sy.No.234 and 235 situated at Pedda Amberpet village, but one P.Shankaraiah and others illegally trespassed into his plot and damaged fencing boundaries in the last month and hence requested to take necessary action as per law.

Upon receipt of the same petition, the Commissioner of Police, endorsed it on 16.10.2018 and forwarded to the respondent Police for necessary action.

On receipt of the said petition on 19.10.2018 at hours through proper channel and immediately an entry was made into the Station General Diary, after enquiry action will be taken. In the preliminary enquiry, it is revealed that in respect of the subject land in question, a civil suit in O.S.No.986 of 2000 was filed before the Hon'ble Court of Prl. Junior Civil Judge, Hyderabad East and North, Ranga Reddy District by Mr.Pilli family members stating that GPA and sale deed documents

which are executed after 14.08.1984 are invalid and obtained judgment in their favour.

The petitioner purchased the plot on 16.06.2018 vide document No.6507/ 2018 which clearly shows that the petitioner purchased the plot after 14.08.1984. Hence, as per the judgment in O.S.No.986 of 2000 the document of the petitioner is not valid. Hence, the petitioner is advised to seek his redressal in a competent Court of law.

Since the dispute of the petitioner herein is purely civil in nature and hence he was advised to seek his redressal in a competent Court of law. To that effect, a notice dated 23.10.2018 was sent to the petitioner through post.

A copy of the notice, dated 23.10.2018, is annexed to this written instructions for the kind perusal of this Hon'ble Court."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Abdullapurmet Police Station, Rachakonda Commissionerate, dated 28.11.2018, with a liberty to the petitioner herein to avail the other remedies open, in accordance with law.
