HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42691 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in issuing the proceedings No.100/F1/2012 dated 16.11.2018, as illegal and arbitrary.

The averments made in the writ affidavit would show that the petitioners were appointed as the agents for collection of garbage on day to day basis from the houses/residents in the Kadapa Municipal Corporation area vide proceedings dated 22.5.2018. While things stood thus, the impugned notice came to be issued on the petitioners, basing on the complaint made by the residents of the locality and cancelled the appointment of agency for collection of garbage, without giving any notice or opportunity of hearing to the petitioners.

Having regard to the facts and circumstances of the case, the impugned order shall be treated as show cause notice and the petitioners shall submit their explanation to the allegations made in the complaint with regard to collection of garbage. The respondents shall furnish a copy of the complaint to the petitioners within a period of two days from today, in which event, the petitioners shall submit their explanation within a period of four days from the date of furnishing the copy of the complaint and thereafter, the authorities concerned shall pass appropriate orders, in accordance with law. Till such time, status quo existing as on today to be maintained with regard to the collection of garbage.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
