HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No. 42678 of 2018 ORDER: (per V. Ramasubramanian, J)

1) The petitioner has come up with the above writ petition challenging the attempt of first respondent-bank to take physical possession of the property of which he claims to be the tenant.

2) Heard learned counsel for the petitioner and Mr.Rama Koteswara Rao, learned counsel appearing for the first respondent.

3) Though the petitioner claims to be a tenant, the affidavit in support of the writ petition is completely silent about the monthly rent and other terms and conditions of lease including the period of lease. Admittedly, the petitioner became a tenant only in November, 2016. Therefore, all that can be done is to grant some time to the petitioner to vacate.

4) Therefore, the Writ Petition is disposed of granting time to the petitioner upto 30th April, 2019 to vacate and hand over possession. Till then the petitioner shall deposit the monthly rents directly to the bank.
