THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.43540 OF 2018 O R D E R :

When the matter is taken up for hearing, learned counsel for the petitioner submits that this writ petition is filed by the petitioner who has been working as Assistant Public Prosecutor, Special (PCR) Mobile Court-cum-JFCM, Sangareddy District seeking payment of salary and for grant of increments. It has been contended by the petitioner that from October, 2017, respondents were not paying salaries to petitioner and she had to apply leave as she was not in a position to discharge her duties without payment of salary. Petitioner further contends that working conditions at Sangareddy are not conducive and that the respondents are not paying salary regularly and contends that her case may be considered for transfer to Hyderabad.

Learned counsel for the petitioner contends that this Court may pass appropriate orders directing the respondents to pay salary and also to release increments to the petitioner and also consider the case of the petitioner for transfer to Hyderabad.

Learned Special Government Pleader appearing for the 2nd respondent contends that respondents had issued proceedings dated 26.11.2018 and 28.11.2018 requesting the petitioner to furnish details of bank account, bank name, branch name, IFSC code etc., so as to enable them to pay salary to the petitioner. The proceedings of the District Social Welfare Development Officer were enclosed where in it is stated that the leave of the petitioner was sanctioned as per her eligibility and that as and when the petitioner furnishes the above

said details, the respondents will take steps to pay salary to petitioner.

This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the petitioner to furnish all the details as sought by the respondents vide proceedings dated 26.11.2018 and 28.11.2018 within one week and thereafter the respondents shall release the salaries to the petitioner in another two weeks. As far as other grievances of the petitioner is concerned i.e. transfer to Hyderabad, non-payment of increments etc., petitioner is given liberty to submit a representation to respondents within two weeks from the date of receipt of copy of this order and the respondents shall consider the same and pass appropriate orders within four weeks thereafter.

With these observations, writ petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
