HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.29315 of 2016 ORDER:

The case of the petitioner is that his father was assigned land to an extent of Ac.05-16 cents in Sy.No.399-1 of Yethirajupalli Village, Badvel Mandal, Kadapa District, which was classified as Assigned waste land as per RSR of Yethirajupalli village. Later his father gifted Ac.1-04 cents and Ac.1-03 cents to his sisters vide document No.1778/1988 and 831/1986. Later his father died in the year 1993 and thereafter, names of third parties are being shown in the revenue records. As such, the petitioner made representation on 22-12-2014 to the respondents. Basing on the representation of the petitioner, the 3rd respondentTahsildar submitted a report dated 12-10-2015 to the 2nd respondent-Revenue Divisional officer (R.D.O.) In pursuance of the same, the R.D.O., Rajampet directed the Tahsildar to submit connected D.K.T. files.

In pursuant to the same, the R.D.O. issued notice to the petitioner on 19-07-2016. As no action has been taken thereafter, the present writ petition is filed. Learned counsel for the petitioner submits that when the father of petitioner died in the year 1993, the question of giving up the land by him in the year 2012 does not arise.

It is to be seen that on the basis of representation of the petitioner, the Tahsildar submitted report and on the basis of the same, the R.D.O. has taken-up enquiry. In view of the same, the 2nd respondent is directed to complete the enquiry, as per law, in pursuance to the notice dated 19-07-2016 after issuing notice to the petitioner as well as to the affected parties. With the above direction, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
