THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.11059 of 2002 O R D E R:

This writ petition is filed by the Andhra Pradesh Road Transport Corporation challenging the award passed by the Labour Court in I.D.No.64 of 1998 dated 27.8.2001.

After filing of the writ petition, the 1st respondent was reinstated into service in compliance of the orders passed by the Labour Court.

On merits of the case, the Labour Court has modified the punishment of removal to that of reinstatement of the 1st respondent as a fresh entrant and the Labour Court has made it clear that the 1st respondent is not entitled for any back wages. As the 1st respondent was directed to be reinstated as a fresh entrant, the question of granting continuity of service and attendant benefits would not arise. Hence, there are no merits in the writ petition to interfere with the award passed by the Labour Court. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
