HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 8083 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ petition impugns the notice, dated 08.02.2016, issued in exercise of the powers conferred on the Commissioner, Greater Hyderabad Municipal Corporation, to recover property tax for the petitioner's premises, as mentioned in the notice. We have perused the notice. It is clear from the language of the notice that it is in the nature of show cause. When we so noticed and asked learned counsel for the petitioner whether petitioner is prepared to file reply within a period of seven days from today showing cause as to why she is not liable to pay the tax as demanded, he instantly agreed for the same and prayed for direction to respondent No.4 to decide the show cause notice within time frame and till then not to take coercive action against the petitioner.

Sri Chatla Madhu, learned counsel for respondent Nos.3 and 4, submits that if the reply is filed within seven days, respondent No.4 shall decide the show cause notice within a period of four weeks therefrom and till then no coercive action shall be taken against the petitioner.

In the circumstances, we are satisfied that the following order will meet the ends of justice:

"If the petitioner gives reply to the notice, dated 08.02.2016 (Annexure PI), impugned in the present writ petition, within a period of seven days from today, respondent No.4 shall consider the same and decide the show cause notice within a period of four weeks therefrom without entering into an issue of limitation. Till then no coercive action be taken against the petitioner."

Miscellaneous petitions, if any, shall also stand disposed of.
