HON'BLE Smt. JUSTICE ANIS Criminal Petition No.14170 of 2016 ORDER:

This Criminal Petition is filed by petitioners, under Section 482 Cr.P.C, seeking quashing of investigation in Crime No.214 of 2016 of Sattenapalli Town Police Station, Guntur District, registered for the offences punishable under Sections 420, 468, 471 read with Section 34 I.P.C. Learned Counsel appearing for the petitioner contends that petitioners and 2nd Respondent are closely related and there are civil disputes pending between them and further there are disputes regarding execution of documents in favour of the 1st petitioner and the 2nd respondent. On the other hand, learned Additional Public Prosecutor opposed the Criminal Petition contending that, since the investigation is still going on, the question of quashing investigation does not arise.

In view of the facts and circumstances of the case, this Court is not inclined to interfere with investigation. However, the Station House Officer, Sattenapalli Town Police Station, Guntur District, is hereby directed not to arrest the petitioners - accused Nos.1 to 3 in Crime No.214 of 2016 till completion of investigation or, filing of charge sheet or final report. With the above direction, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
