HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.3288 OF 2016 ORDER:

The present Civil Revision Petition is filed, under Article 227 of the Constitution of India, by the petitioners - plaintiffs, challenging the order, dated 07.11.2015, passed in I.A. No.924 of 2014 in O.S. No.158 of 2011, by the Principal Junior Civil Judge, Repalle, whereby the petition filed under Order XXVI, Rule 9 of the Code of Civil Procedure, 1908, seeking to appoint an Advocate-commissioner to inspect the suit schedule property and note down the physical features on land and to file his report with a plan, was dismissed.

2. As per the material placed before this Court, during pendency of the present revision, the Original Suit bearing No.158 of 2011, itself was dismissed on 22.09.2017 on contest. Therefore, nothing remains to be adjudicated by this Court in the present revision.

3. Accordingly, the Civil Revision Petition is dismissed as infructuous. No order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the present revision, stand closed.
