Counsel for the 4th respondent : -- THE COURT MADE THE FOLLOWING ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed against order dated 09-06-2016 in M.A.No. 794 of 2016 in O.A.No. 6022 of 2015 on the file of the Andhra Pradesh Administrative Tribunal at Hyderabad (for short, 'the Tribunal').
2. We have heard Sri P.V.Krishnaiah, learned counsel for the petitioner, and perused the record. The petitioner has filed the above mentioned O.A. feeling aggrieved by the non-consideration of his candidature for appointment in the eleventh vacancy of the post of Dental Assistant Surgeon caused on account of non-joining of the candidate above the petitioner in the merit list. The petitioner has filed the above mentioned miscellaneous application seeking for fixing an early date of final disposal of the O.A. The
Tribunal dismissed the said application by observing that there is no special urgency in the matter. In our opinion, while exercising the jurisdiction of judicial review, this Court ordinarily will not sit in an appeal over the satisfaction arrived at by the Tribunal regarding the urgency for early hearing of the main case. Hence, we do not find any reason to interfere with the impugned order. The Writ Petition is, accordingly, dismissed.
4. As a sequel to dismissal of the Writ Petition, W.P.M.P.No. 24836 of 2016 shall stand dismissed as infructuous.
