HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 2 8 5 3 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Begum Bazar Police Station, Hyderabad, dated 30.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The facts of the case are that one Md.Zahoor Ali had lodged a complaint on 03.10.2018 with the respondent No.2 Station House Officer, Begum Bazar Police Station, Hyderabad, wherein he stated that on 03.10.2018 the petitioner herein abused him in filthy language. Basing on the said complaint, a petty case was registered as No.HYD02PC18100871, under Section 70(B), 186 I.P.C., against the petitioner and the charge sheet is being filed.
It is submitted that the 2nd respondent called the petitioner for the purpose of enquiry on several dates, but it does not mean harassment or detention. It is submitted that except registering the above petty case, the 2nd respondent did not detain the petitioner in the Police Station as alleged by him. It is submitted that the petitioner instead of cooperating with the enquiry in the above petty case, filed the present Writ Petition with baseless allegations.
It is submitted that the present Writ Petition has been filed mere apprehension only. It is submitted that the contention of the petitioners against the respondent No.2 is incorrect and baseless. The Writ Petition is devoid of merits and liable to be dismissed."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Begum Bazar Police Station, Hyderabad, dated 30.11.2018.
