This appeal is filed by the appellant aggrieved by the judgment and decree in A.S.No.5 of 2016 dated 08.09.2017 on the file of the Chairman (MACT) II Additional District Judge, Mancherial and the judgment and decree in O.S.No.13 of 2009 (old O.S.No.75 of 2006) dated 30.01.2016 on the file of the Principal Senior Civil Judge at Mancherial. 2.

When the matter is taken up for hearing, the learned counsel for the appellant submitted that the appeal would become infructuous as the matter was settled out of court, as such he is not pressing the appeal. 3.
