HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34324 OF 2016 ORDER:

This Writ Petition under Article 226 of the Constitution of India is preferred by the petitioners seeking to declare the inaction of the 3rd respondent in issuing pattadar passbooks and title deeds in favour of the petitioners as illegal and arbitrary and consequently to direct him to effect mutation and issue pattadar passbooks and title deeds in respect of the land admeasuring Ac.0.56 cents in Survey No.35-4 situated at Saidapuram Village, Kadiri Mandal, Ananthapuram District.

Heard the learned counsel for the petitioners as well as the learned Government Pleader for Revenue (AP).

As seen from the material on record, the petitioners jointly purchased the subject land from Mannem Narayana Swamy and another under Registered Sale Deed dated 02.04.2015 bearing document No.798 of 2015 and since then they claim to be in possession and enjoyment of the said property. It is their grievance that in spite of submitting applications for necessary mutation and issuance of e-passbook by paying requisite fee, the respondents are not acting upon the same. Hence, the present writ petition.

Having considered the rival submissions, the present writ petition is disposed of directing the 3rd respondent herein to consider the application dated 12.07.2016 made by the petitioners and dispose of the same in accordance with law, if the same is still

pending consideration, after hearing the petitioners and also the aggrieved persons, if any, as early as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
