This Writ Petition is filed seeking writ of mandamus declaring the action of the respondents 3 to 5 in not considering the application No.2018-17642728 and representation dated 15.10.2018 and the recommendation of the 2nd respondent by letter dated 18.01.2017 for rectifying, measuring and fixing the boundaries of the land admeasuring Acs.2.60 cents at Sy.No.706 in Konanki Village of Piduguralla Mandal, as illegal and arbitrary. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.
Learned Assistant Government Pleader for Revenue appearing for respondents produced written instructions stating that in pursuant to application made by the petitioner in pursuance of orders passed in earlier WP No.8699 of 2017, an endorsement was issued on 22.10.2018 by the 4th respondentTahsildar, Piduguralla to produce the documents like patta issued in favour of the petitioner as Ex-Military person in respect of the subject land. But the petitioner has not produced any such documents.
On the other hand, learned counsel for the petitioner submits that the petitioner has produced all necessary documents, but only to help the adjacent land owners, the respondents are not taking any further action on the application
of the petitioner dated 15.10.2018. He submits that earlier notice was issue for conducting survey.
In this case, it is to be seen that in the written instructions, though it is stated that endorsement was issued by the 4th respondent, but the same is not enclosed and report of the 5th respondent is filed. These facts would go to show that no orders are passed by the 4th respondent on the application of the petitioner for conducting survey. Along with written instructions, a copy of notice dated 26.05.2017 is also produced with regard to conducting of survey in respect of subject land. In view of above facts and circumstances, the petitioner may once again produce necessary documents before the 4th respondent and on such production, the 4th respondent is directed to take appropriate action for conducting survey and demarcation of lands within a period of eight weeks from the date of receipt of application and other relevant documents.
With the above direction, this Writ Petition is disposed of. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
