HON'BLE THE CHI EF JUSTI CE SRI THOTTATHI L B. RADHAKRI SHNAN AND HON'BLE SRI JUSTI CE A. RAJASHEKER REDDY WRI T APPEAL No.1576 of 2018 JUDGMENT: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard learned counsel for the appellant and learned Government Pleader for Commercial Taxes appearing for the respondents.

This Writ Appeal is against an interlocutory order passed by the learned Single Judge during the course of the Writ Petition. The appellant is not aggrieved by the grant of one week time to submit explanation to the competent authority. 3.

Learned counsel says, in answer to the query, that his client has actually submitted explanation.

The only issue is in relation to the direction to treat the appellant under suspension from the date of the impugned order. According to the petitioner, it should have actually been from the date on which he reported to join duty. That is not the matter to be heard in the Writ Appeal by us.

As the Writ Petition is still pending, it will be open to the appellant to seek appropriate clarificatory orders or further

HCJ & ARR, J W.A.No.1576 of 2018 directions from the learned Single Judge, as may be found fit to be granted at that end.

Without prejudice to that, this Writ Appeal is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed.
