THE HONOURABLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.1289 OF 2016

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 26.04.2016 passed in W.P.No.14164 of 2016. By the said order, the Commissioner, Greater Hyderabad Municipal Corporation, was directed to ensure that the petitioner's complaint dated 16.03.2016 was considered and appropriate action was taken thereon in accordance with the due procedure. By the said complaint, the petitioner alleged that the municipal authorities were not taking action in relation to the illegal constructions made by the third respondent in the writ petition. This Court made it clear that the authority concerned would have to give an opportunity of hearing to all the parties who would be affected by any decision taken upon the petitioner's complaint while dealing with the matter.

The Commissioner, Greater Hyderabad Municipal Corporation, filed a counter stating that notices were issued to the unofficial respondent in the writ petition with regard to the removal of the unauthorized constructions made by her and ultimately, an order was passed under Section 636 of the Greater Hyderabad Municipal Corporation Act, 1955, leading to demolition of the illegal constructions.

In the light of the aforestated averments, which remain unrebutted, it is clear that the municipal authorities have taken appropriate action in the matter as directed.
