HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CONTEMPT CASE No.2241 OF 2017 ORDER:
Heard.
The very prayer in the Writ Petition is, inaction of the respondents in not paying compensation for acquisition of the petitioner's agricultural land of Ac.1.50 cents in Survey No.442/3 of Vikrutamala Village of Yerpedu Mandal of Chiddoot District, that was disposed of by directing the writ petitioner to submit proof in relation to the subject property in support of the proceedings submitted by the Tahsildar also for his entitlement and respondents, if necessary, by giving show-cause notice to 5th respondent conduct enquiry, and the writ petitioner is permitted to submit fresh representation, within one (1) week, and the authorities shall pass appropriate orders within six (6) months thereafter.
The present Contempt Petition is filed saying the Sub-Collectorcum-Land Acquisition Officer-cum-Special Joint Collector, Tirupathi, willfully disobeyed and violated the order of this Court supra, dated 13.07.2017, in Writ Petition No.22051 of 2017. The submission in the counter-affidavit of the respondent, SubCollector, is that they did not acquire the land of Ac.1.50 cents in Survey No.442/3, and once there are no proceedings or proposal much less for acquisition, there is no any contempt.
By recording the same, the Contempt Petition is closed, for petitioner if at all owner of the property of Ac.1.50 cents in Survey No.442/3, can enter possession and otherwise take other appropriate legal recourse.
Dr.SSRB,J C.C. No.2241/2017 As a sequel, the miscellaneous applications, if any pending, shall stand closed.
