THE HONOURABLE SRI JUSTICE RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.42791 OF 2018 ORDER: (per Hon'ble Sri Justice Raghvendra Singh Chauhan) In compliance of the order dated 26.11.2018, respondent No.3 - the Station House Officer, Gajwel Police Station, has produced Mr.K.Dinesh Chakrawarthy, the detenue before this Court. Learned Government Pleader for Home submits that upon receipt of notice in this case, police registered a case of man missing in Crime No.264 of 2018 of Gajwel Police Station. Subsequently, police contacted the detenue over phone and directed him to meet the police at HDFC Bank, Himayatnagar, Hyderabad. According to the respondent No.3, detenue was picked up from the said place and produced before this Court. This Court has also spoken to Mr.K.Dinesh Chakrawarthy, who informs this Court that:
Firstly, he was not taken by anyone after he had filed his nomination papers for the upcoming Assembly Elections. According to him, since his cell phone had broken down, he was not in a position to contact anyone. Therefore, an impression had been created in the mind of the petitioner that, perhaps he has been abducted by someone after he has filed nomination papers. Secondly, according to him, he has withdrawn his nomination voluntarily for the upcoming Assembly Elections. Thirdly, according to him, there is no threat to his life and he has not been kept under any illegal detention by any person. Since the detenue had been produced before this Court and he was never confined in illegal detention and since he faces no threat
RSC,J & MSM,J Wp_42791_2018 to his life, to his person, this Court does not find any merit in this writ petition. Therefore, the writ petition stands disposed of. Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
