Feeling aggrieved by Order, dated 01-032016, in OA.No.871 of 2016, on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short 'the Tribunal'), the unsuccessful applicant therein filed this Writ Petition.
We have heard Mr.A.Rajendra Babu, learned Counsel for the petitioner, and perused the record. While working as Senior Assistant in Duttaluru, SPSR Nellore District, the petitioner was placed under suspension by Order, dated 29-122015, of respondent No.3. The said order of suspension was made against the petitioner based on the report, dated 01-08-2015, of the Inspector of Police, CID, Regional Office, Nellore, wherein it was stated that while working at Primary Health Center, Mypadu, during the year 2007-2008, the petitioner has drawn Rs.75,000/- from the Bank by the aid of a forged signature of the Medical Officer and thereby, misappropriated Government funds. The Tribunal declined to interfere with the order of suspension with liberty to the petitioner to file an
appeal, if he feels aggrieved by his suspension. Having considered the reasons assigned by the Tribunal for its non-interference with the order of petitioner's suspension, we do not find any illegality therein, more so, when the petitioner was permitted to avail the remedy of appeal.
Therefore, the Writ Petition is dismissed leaving the petitioner with liberty to file an appeal against the order of his suspension.
