Heard.

The present writ petition came to be filed questioning the order dated 03.03.2016, passed by the second respondent in F.No.5/ Hyd/ C/ 2016-Z-I, as illegal and arbitrary.

The main ground urged by the learned counsel for the petitioner is that the committee came to be constituted by third respondent without following the procedure contemplated under Sections 70 and 71 of the Wakf Act, 1995. 4.

Today when the matter is taken up for hearing, the counsel the petitioner himself submitted that the second respondent has initiated fresh proceedings fulfilling the requirements of Section 71 of the Wakf Act. 5.

In view of the above, nothing survives for adjudication in the writ petition. Accordingly, the writ petition is disposed of directing the respondent-authorities to maintain status-quo with regard to the towliyath, management of the Maqbera Nawab Etesmul-Mulk, for a period of two months from the date of receipt of a copy of the order. Meanwhile, the authorities shall complete the enquiry and pass orders, in accordance with law. No costs.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
