Heard.

The grievance of the petitioner that though she is the Sarpanch may be on account of the fact that she does not belong to the ruling party, the other committee members are not consulting her for execution of the works which are allocated to the village and which are required to be carried out in terms of G.O.Ms.No.22, dated 09-10-2014.

It is the specific assertion that the petitioner does not have any objection in carrying out the works as identified and allocated to the village except that she has a grievance that she is not being consulted. A careful reading of G.O.Ms.No.22, dated 09-10-2014 read with G.O.Rt.No.531, dated 14-08-2015 does not indicate that there being any procedure with regard to convening of any meeting or passing of any resolutions of Mavooru-Janmabhoomi Committees. The intention of the Government in passing G.O.Ms.No.22, dated 09-10-2014 and notifying the procedural guidelines in G.O.Rt.No.531, dated 14-08-2015 is to achieve the object of execution of works at village level as expeditiously as possible without there being any bureaucratic hurdles.

It is expected that all the members of the respective committees to work unanimously and utilize the funds, which are being provided for execution of the works. The same can be achieved only when there is coordination among the elected members, which neither the officer can bring in by force or capable nor can be enforceable by the Court. However, the Village Level Officers who are connected with the ground level execution works shall ensure co-ordination among the members and ensure that the works allocated to the committees are executed strictly adhering to the standards notified without compromising on the quality of the work. Merely on account of the fact that one or other member has grievance, the works cannot be stalled.

Hence, the writ petition is disposed of directing the respondents to

ensure that the works are executed in terms of the quality as notified and within the time stipulated involving all the members. No order as to costs.
