The case of the petitioner is that the 3rd respondent - Tahsilar, issued notice vide Rc.No.420/2017 SA dated 12.10.2018 under Section 7 of the Land Encroachment Act, and the petitioners filed their explanation on 19.10.2018 and without considering the same when the 3rd respondent issued notice under Section 6 of the said Act on 26.10.2018 vide Rc.No.420/2017/SA, they preferred appeal before the 2nd respondent - Revenue Divisional Officer on 22.11.2018 along with stay petition, and while the same are pending adjudication, 3rd respondent is taking steps to evict them from the subject land. Hence, the writ petition.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
Having regard to the facts and circumstances of the case and the submissions of the learned counsel, without expressing any opinion on merits, writ petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioners against the notice issued under Section 6 of the Act dated 26.10.2018, in accordance with law, as expeditiously as possible. Till then the petitioners shall not be dispossessed from the subject lands. Interlocutory applications pending, if any, shall stand closed.
