THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14182 of 2016 ORDER:

The petitioner states that he was working in the first respondent University since 03.01.1992. He is presently working as Junior Assistant in the University College of Science, Osmania University, Saifabad, Hyderabad. It is stated that one M.Yadagiri supplies vegetables to the hostel mess/kitchen of the University Hostel. It appears that on 17.11.2015 when the petitioner was going to Tirumala to have darshan of Lord Venkateswara, the said Yadagiri asked him to collect money to drop the same in the Lord's hundi at Tirumala. In that connection the taxi in which they were going took a diversion and met Yadagiri, who handed over cash for dropping the same in hundi. His case is that the said amount is meant for placing in the hundi, but not as a bribe.

He was arrested by the Anti Corruption Bureau and sent to judicial custody, but later on he was enlarged on bail. He submitted a representation on 30.03.2016 stating that in respect of another employee of the University, who was also involved in corruption, an order was passed on 05.02.2016 reinstating the employee into service, but in respect of his representation no response was received from the University. He filed the present Writ Petition seeking similar treatment to him in spite of pendency of case against him and also challenges the order dated 28.11.2015 suspending the petitioner from service. In view of the serious allegation levelled against the petitioner, this Court is not inclined to set aside the order of suspension.

However, this Writ Petition is disposed of directing the first respondent to proceed with the enquiry and complete the same in accordance with law as early as possible. It is also further directed that the second respondent shall take into consideration the representation dated 30.03.2016 submitted by the petitioner and dispose of the same in accordance with law as expeditiously as possible.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
