THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21990 OF 2016 ORDER:

The writ petition is filed to declare the action of the 3rd respondent in conducting panchanama dated 25.06.2016 and seizing the Dals worth Rs.28,32,750/- and consequently to release the same on furnishing third party security.

Heard learned counsel for the petitioner and learned Government pleader.

A perusal of the panchanama dated 25.06.2016 discloses that on the allegation of not tallying with the ground stock with the registers, the goods lying in the godown of the petitioner were seized.

An enquiry with respect to violation of Telangana Pulses, Edible Oils, Edible oilseeds (Licencing, Storage and Regulation) Order, 2015 is yet to be conducted by issuing notice under Section 6A of the Essential Commodities Act. But as on date no such notice has been issued.

In those circumstances, pending initiation of proceedings and pending further orders, there shall be stay of sale of seized goods. The respondent-authorities shall take necessary steps by issuing show cause notice to the petitioner and complete the enquiry within a period of three (3) months from the date of receipt of copy of this Order.

The writ petition is accordingly disposed of. No order as to costs.

In view of disposal of the main writ petition, miscellaneous petitions pending in the writ petition, if any, shall stand closed. _________________________ Challa Kodanda Ram, J 14th July, 2016.
