THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12774 of 2016 ORDER:
The case of the petitioner, as per the affidavit averments of the petitioner, is that very close to his house, an open site admeasuring 266.66 Sq.Yards is available in survey No.240-1, which belongs to Sri Hathiramji Mutt under the control of Endowments Department. Alleging that some private individuals were trying to raise construction of a Dhaba in the said place, petitioner filed the present writ petition contending that though a representation was submitted to authorities concerned, no action was taken.
Heard the learned counsel for the petitioner, learned Government Pleader for Endowments and Sri K.R. Prabhakar, learned counsel for the 4th respondent. Learned counsel for the 4th respondent submits that number of civil litigations are pending with respect to subject property and the 4th respondent would take all necessary steps to protect its right over the subject property. As a matter of fact, learned counsel submits that against the orders passed by Inam Deputy Tahsildar, appeals have been filed before the Revenue Divisional Officer and they are pending.
Recording the said submission of the learned counsel for the 4th respondent, this writ petition is closed, however, directing the Revenue Divisional Officer to dispose of the appeals as expeditiously as possible.
