The case of the petitioner is that he made representation on 26-09-2017 for grant of six installments for payment of current consumption charges for the month of August, 2017 and the same is not considered in terms of Regulation 5 of 2004, provisions of Electricity Act, 2003 and Clause 8.2.3 of the General Terms and Conditions of Supply. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that due to adverse market conditions, financial position of the petitioner-company is badly affected and the petitioner is not in a position to pay bill at one stretch and in similar circumstances this Court disposed of writ petition No.25668 of 2016 and that the petitioner will pay amount of Rs.12,45,407/- will be paid in a week and the rest of the amount shall be paid in five installments by 20th of every succeeding month commencing monthly from December, 2017.
In view of the above facts and circumstances, the respondents are directed to permit the petitioner to pay rest of the amount in five monthly installments payable by 20th of every succeeding month commencing from December, 2017. Till such time, the respondents shall not disconnect power supply to the service connection of the petitioner. Grant of
installments by this Court is subject to payment of interest by the petitioner as per Tariff order. In the event of failure to pay the installments as indicated above within the stipulated time, the respondents are at liberty to take action including disconnection of power supply as envisaged under Section 56 of the Electricity Act.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 03-11-2017 Nvl
