HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42822 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not considering the representation dated 24.11.2018 submitted by the petitioners requesting the respondents not to make any constructions and dig pits across the cart tracks which leads from Sy.No.211 and 212/7 to ingress and egress to the agricultural fields and also to go to Tirupati Renigunta from Kotramangalam, Damineedu and Pannerkalva Village, as illegal and arbitrary.

Learned counsel for the petitioners submits that though the petitioners submitted a representation on 24.11.2018 to the 2nd respondent requesting not to make any constructions and dig pits across the cart tracks which leads from Sy.No.211 and 212/7 to ingress and egress to the agricultural fields and also to go to Tirupati Renigunta from Kotramangalam, Damineedu and Pannerkalva Village, no orders are passed so far.

Learned Standing Counsel for the 2nd respondent would submit that a direction may be given to the 2nd respondent to dispose of the representation submitted by the petitioner, in accordance with the law. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent to deal with the representation dated 2411.2018, submitted by the petitioners requesting the respondents not to make any constructions and dig pits across the cart track which leads from Sy.No.211 and 212/7 of Damineedu Village, Tirupati Rural Mandal, Chittoor District, to ingress and egress to the agricultural fields and also to go to Tirupati-Renigunta from Kotramangalam, Damineedu and Pannerkalva Village, and pass appropriate orders in accordance with law as early as possible, preferably

within a period of three to six weeks from the date of receipt of copy of this order after giving reasonable opportunity of hearing to the petitioners and all concerned. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
