This Transfer Civil Miscellaneous Petition is filed under Section 24 C.P.C. seeking to withdraw FCOP No.2479 of 2016 on the file of XVI Additional District and Sessions Judge, Cyberabad, Malkajgiri, Rangareddy District, and transfer to Family Court, City Civil Court at Secunderabad.

02. Heard both the counsel.

A perusal of the record reveals that the respondent filed O.P.No.841 of 2015 on the file of Judge, Family Court, City Civil Court, Secunderabad, against the petitioner under Section 13 (1) (ia) and (ib) of Hindu Marriage Act, for dissolution of marriage between them. The respondent also filed O.P.No.2479 of 2016 on the file of Judge, Family Court, Rangareddy District at L.B.Nagar, to evict the petitioner from the petition schedule property. Subsequently, the OP was transferred to XVI Additional District and Sessions Judge, Cyberabad, Malkajgiri, Rangareddy District.

04. The parties in both the matters are one and the same. The petitioner is the wife of the respondent. The respondent filed one O.P. in Family Court at Secunderabad and another O.P. in Family Court, Rangareddy District at L.B.Nagar, which was transferred to XVI Additional District and Sessions Judge,

Cyberabad. In order to avoid conflicting Judgments, this Court is of the considered view that it is a fit case to allow the petition. Taking into consideration the facts and circumstances of the case, this Transfer Civil Miscellaneous Petition is allowed and F.C.O.P.No.2479 of 2016 on the file of XVI Additional District and Sessions Judge, Cyberabad, Malkajgiri, Rangareddy District, is withdrawn and transferred to the Court of the Judge, Family Court, City Civil Court at Secunderabad, for disposal in accordance with law.
