Heard learned counsel for the petitioner and Sri Pushyam Kiran, representing the respondent and interim order passed by the lower court is made absolute, in directing the lower court subject to the observations therein, to dispose of the application afresh.

Accordingly and with the above observation, this civil revision petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
