HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Company Application No.860 OF 2017 In CP No.39 of 2000 ORDER:

This Company Application is filed by the Official Liquidator under Section 460 (4) of the Companies Act, 1956 ( for short 'the Act of 1956') r/w Rule 9 of the Companies (Court) Rules, 1959 to permit the Official Liquidator (OL) to pay the Advocate's fees in SLP (C ) No.29561-62 of 2014 on the file of Hon'ble Supreme Court of India.

This Court, vide orders dated 15.04.2015, in Company Application No.689 of 2015, appointed Sri M.Srinivas R. Rao, Advocate to represent SLP (C ) No.29561-62 of 2014 before the Hon'ble Supreme Court and his fee is provisionally fixed at Rs.25,000/-, which may be varied in future depending upon the work and services rendered by him.

Heard, learned Counsel for the Official Liquidator, who submits that the SLP (C) No.29561-62 of 2014 was dismissed on 03.11.2017 by the Hon'ble Supreme Court. He also submits that the aforesaid SLP underwent four adjournments and finally dismissed on 03.11.2017. He further submits that said Sri M. Srinivas R. Rao, learned Advocate claims an amount of Rs.1,10,000/- through letter dated 06.11.2017 to the Official Liquidator.

This Court, by order dated 15.04.2015 in Comp.A.No.689 of 2015 provisionally fixed Advocate's fee of Rs.25,000/- in representing SLP before the Supreme Court, which was ultimately dismissed on 03.11.2017. Therefore, this Court feels it appropriate to fix the Advocate's fee at Rs.75,000/- (Rupees seventy five thousand only). Since already an amount of Rs.25,000/- was paid to said Sri M.Srinivas R. Rao by virtue of this Court's order dated 15..04.2015, the Official Liquidator is directed to pay the balance amount of Rs.50,000/- (Rupees fifty thousands only) to Sri M.Srinivas R. Rao.

Accordingly, this application is ordered.
