THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2531 OF 2016 ORDER:

This petition is filed by the petitioners-A1 to A4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.230 of 2015 on the file of the V Additional Judicial First Class Magistrate, Rajahmundry, East Godavari District. The petitioners are alleged to have committed the offence punishable under Sections 498-A, 495 and 420 r/w 34 IPC. Considering the facts and circumstances of the case and the allegations made in the complaint, this Court is not inclined to interfere with the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of petitioners-A1 to A4 before the trial Court is dispensed with except on the date of framing of charges, on the date of their examination under Section 313 Cr.P.C., on the date of the judgment and on the dates when their presence is insisted by the trial Court. The petitioners shall be represented by their Counsel in the above C.C. on all hearing dates. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
