THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1612 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioners/A-1 to A-7 seeking to quash the proceedings in Crime No.95 of 2015 on the file of the Narsapur Police Station, Adilabad, Adilabad District.
2. The petitioners are facing allegations for the offences punishable under Sections 290, 323, 498-A, 448, 379, 506(ii) read with 34 and 494 read with 109 I.P.C. The petitioners and respondent No.2/de facto complainant, who is the wife of petitioner No.1, informed that they settled the matter out of Court. Further, the de facto complainant informed that she is not interested in prosecuting the matter as she has joined with petitioner No.1 herein.
3. Heard and perused the material on record.
4. Both parties are present and they are identified by their respective counsel. In view of the compromise entered into between the parties and as the offences arose out of matrimonial disputes, the petitioners are permitted to compromise the matter.
5. Accordingly, the Criminal Petition is allowed quashing the proceedings in Crime No.95 of 2015 on the file of the Narsapur Police Station, Adilabad, Adilabad District. However, the petitioners are directed to pay a sum of Rs.2,000/- (Rupees two thousand only) towards costs to the Telangana State Legal Services Authority, Hyderabad and the Registry is directed to issue copy of the order on production of receipt of the same.
6. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
