THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.38979 OF 2016 ORDER :

Petitioner alleges that he owns private residential house and though he applied for provision of water connection to his residential building, erroneously, the respondent-Board has granted commercial water connection imposing higher liability. Having come to know of the same, the petitioner made a representation on 21.06.2016 that the said building is not used for commercial purpose. However instead of considering his grievance and rectifying the mistake, the respondents communicated final notice dated 05.11.2016, directing the petitioner to pay an amount of Rs.52,552/- treating the water connection provided to him as for commercial purpose.

Learned Standing counsel, on instructions, fairly submits that the issue of conversion of the water connection provided to the petitioner from commercial to residential is pending consideration of Chief General Manager (Engg), HMWS&SB, O & M Circle-I, Goshamahal, Hyderabad (3rd respondent).

Having regard to these submissions, the writ petition is disposed of directing the 3rd respondent to pass orders on the issue of conversion of water supply connection provided to the building of the petitioner from commercial to domestic. Till such a decision is taken, the notice dated 05.11.2016 shall be kept in abeyance and shall not be enforced and the water shall be supplied

continuously to the building of the petitioner. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
