THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2332 of 2016 ORDER:

This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.1 and 2, seeking to quash the proceedings in Crime No.134 of 2016 on the file of KPHB Colony Police Station, Kukatpally, Cyberabad, Ranga Reddy District.

Heard and perused the material available on record. The offence alleged against the petitioners is punishable under Section 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The de facto complainant is the son-inlaw of the petitioners. The de facto complainant married the daughter of the petitioners against their will and subsequently, the petitioners have taken away their daughter from the de facto complainant and abused him in the name of his caste.

Learned counsel for the petitioners submitted that the petitioners are ready to cooperate with the investigation and in view of the pendency of the above crime, the petitioners apprehend arrest and harassment in the hands of the police.

Considering the facts and circumstances of the case and in view of the submission of the learned counsel for the petitioners, the police concerned are directed to complete the investigation without arresting the petitioners. The petitioners are directed to appear before the police concerned as and when their presence is required and cooperate with the investigation and also after filing of charge sheet, they shall appear before the Court concerned and also execute personal bond for Rs.10,000/- (Rupees ten thousand only) each for the their future appearance before the Court concerned.

With the above directions, the Criminal Petition is dismissed. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J February 25, 2016.
