Appellant/husband and respondent/wife along with their counsel are present before this court.

Learned counsel for the parties state on instructions that during the pendency of the present appeal, the parties have approached the learned Family Court for seeking divorce by mutual consent and therefore, the appellant does not wish to press the present appeal on merits.
