HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43059 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for Greater Hyderabad Municipal Corporation, appearing for respondent Nos.2 to 3.

2) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.1 to 3 seeking to demolish the temporary shed on the penthouse in building Nos.1-2-39/10 & -2-39/11 on plot Nos.5,6,15 and 16 in Survey No.125, admeasuring 800 square yards, situated in Nizampet road, Hydernagar, GHMC Kukatpally circle, Balanagar Mandal, Rangareddy district, without issuing prior notice to the petitioner, as illegal and arbitrary.

3) The grievance of the petitioner appears to be that respondent Nos.1 to 3 are intending to demolish the temporary shed being constructed on the penthouse of the said buildings, without following due process of law.

4) Learned Standing Counsel would submit that any action to be taken by the authorities shall only be in accordance with law.

5) Having regard to the above, the Writ Petition is disposed of directing the respondents not to take any coercive steps in respect of the temporary shed on the penthouse in building Nos.1-2-39/10 & -2-39/11 on plot Nos.5,6,15 and 16 in Survey No.125, admeasuring 800 square yards, situated in Nizampet road, Hydernagar, GHMC Kukatpally circle, Balanagar Mandal, Rangareddy district, without following due process of law. 6) There shall be no order as to costs.
