UMA DEVI WRI T PETI TI ON No.37937 of 2017 ORDER: (per Justice Sanjay Kumar) The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent Bank in not receiving the amount for release the properties of E-Auction Notice dated 17-10-2017 as bad, arbitrary and in violation of Articles 14, 19 and 21 of Constitution of India and all Canons of Law and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
Sri Maruthi Jadhav, learned counsel representing Sri B.S.Prasad, learned counsel for the State Bank of India, would inform this Court that the auction sale proposed to be held on 09.11.2017 pursuant to the impugned e-auction sale notice dated 17.10.2017 did not materialise for want of bidders.
In that view of the matter, challenge in this writ petition is rendered purely academic and does not warrant consideration on merits. The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
