THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.42869 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Education, apart from perusing the entire material available on record.

The District Educational Officer, Visakhapatnam District-third respondent herein, by way of proceedings in Rc.No.7006/B4/2018, dated 22.11.2018, while pointing out certain alleged latches on the part of the petitioner-institution, called upon the petitioner herein to show cause, within three days from the date of receipt of the proceedings, why it shall not be proposed for withdrawal of recognition.

According to the petitioner, an explanation was submitted on 22.11.2018 to the third respondent in response to the said show cause notice and, thereafter, petitioner herein also submitted an elaborate explanation on 25.11.2018.

Copies of the said explanations, dated 22.11.2018 and 25.11.2018, are filed along with Writ Petition.

In the above background, the grievance of the petitioner, as advocated by the learned counsel for the petitioner, is that, without passing any orders on the said explanations, submitted in response to the show cause notice, respondent authorities are contemplating to close the school by putting lock and key and, if the same is permitted, the students prosecuting studies in the petitioner-school will have to sustain irreparable loss and hardship. It is submitted by the learned Government Pleader, on the other hand, that the explanations submitted by the petitioner herein

will be considered and appropriate further action will be taken, strictly in accordance with law.

Recording the above submission, Writ Petition is disposed of, directing the third respondent herein to consider the explanations, dated 22.11.2018 and 25.11.2018, said to have been submitted by the petitioner herein, in response to the show cause notice, dated 22.11.2018, and pass appropriate orders, strictly in accordance with law. Till the said exercise attains finality, respondent authorities shall not interfere with the activities of the petitioner-institution. There shall be no order as to costs.
